TERMS AND CONDITIONS

1. General conditions

The present general conditions of sale are agreed between Maria da Conceição Santos Guerreiro, with the taxpayer number 190310820 and with the tax address Sitio de Bias do Sul CP 910-Z, 8700-067 Moncarapacho, hereinafter referred to as “Só Algarve” and the people who make purchases through the Só Algarve Website - www.soalgarve.pt hereinafter referred to as “customer”.

Purchases made through this website are governed only by these general conditions of sale excluding any conditions previously available on the Website or by prior express and written agreement.

The purchase of any product in the online store of Só Algarve implies the client's acceptance of these Terms and Conditions.

1.1 - The images may differ from the real appearance of the products, without changing their basic characteristics.

1.2 - Prices and specifications subject to change without notice.

1.3 - SÓ ALGARVE declines any responsibility for any errors published on the website, including any errors in updating prices, available quantities, images and technical characteristics.

1.4 - Orders will only be valid after our confirmation.

1.5 - All articles referred to on this site are the property of artisans / producers, having no relationship with SÓ ALGARVE.

1.6 - Any and all copies of the information and articles included on the website, catalogs, manuals or other means of communication require written authorization from SÓ ALGARVE.

2. Production time

2.1 - Each article is unique and made by hand and each artisan / producer has its own pace.

2.2. - For many items there is a stock reservation, others are only made to order.

2.3 - Some articles are quick to execute, others more elaborate and, inevitably, longer. Therefore, there is no predetermined period for delivery of orders.

2.4 - Upon receipt of the order, we estimate the delivery time, which is then communicated to the customer.

2.5 - The photographs are merely illustrative. We suggest a careful consultation to the characteristics of each product. Note that the dimensions of each product will be approximate to those indicated in the technical sheet.

2.6 - In the case of a sold-out product that cannot be shipped within the normal period, we will contact the customer by e-mail, to inform the new delivery date of the product.

2.7 - In the event of a stockout or product discontinuity, your order may be canceled.

     2.7.1 - In this situation, the amount charged will be returned to your account.

3. Prices

3.1 - Prices are in Euros and include VAT at the legal rate in force in Portugal at the time of purchase of the product (s).

3.2 - To the value of the products will be added the costs inherent to the shipping costs.

     3.2.1 - If you are a resident outside the European Union, we ask that you pay special attention to the collection of customs services in your country. Additional customs fees may apply. These fees are the responsibility of the customer and vary from country to country.

4. Ordering

4.1 - All orders are subject to our prior acceptance.

4.1.1 - This acceptance does not include the initial e-mail confirming the order entry, but the human verification of the order, as soon as it enters the system.

4.2 - If the ordered item (s) do not exist in stock and its execution is necessary, it will only be carried out with the receipt of the value corresponding to the product

4.3 - The order will only be dispatched after confirmation of the entry of the two payments: "order" and "shipping costs".

4.4 - The customer must communicate the receipt of the order and confirm, within a period of 48 hours, that all products are in perfect condition.

     4.4.1 - If this procedure is not carried out and any product is damaged, Só Algarve will not have the means to determine the cause of the damage.

     4.4.2 - Só Algarve is not responsible for any damage caused to the products or to the order after dispatch of them from its facilities.

5. Payment methods

You can pay for your order in the following ways:

5.1 - Bank transfer - In this case, a bank transfer is made using the data that will be sent to you by e-mail together with the order confirmation.

     5.1.1 - The customer should be aware that all expenses related to this action are the responsibility of the originator.

     5.1.2 - To speed up the process, please send the bank transfer receipt to the email: geral@soalgarve.pt indicating the order number.

5.2 - MB Way - Just enter the phone number registered with MBWay

5.3 - The order is only sent to the artisan / producer after confirmation of payment.

6. Shipment of the order

6.1 - Orders are dispatched by the carriers we work with. If you want your order to be shipped through an operator of your choice, you must include this information in your order.

6.2 - The customer is responsible for receiving or collecting the goods within the period stipulated by the carrier.

6.3 - Shipping costs will add to the total value of the order.

6.4 - To the costs indicated for shipping, the shipping fee will be added (not including taxes at destination):

           a) - Switzerland - 15,50 €

           b) - Norway - 19,77 €

           c) - Bosnia and Herzegovina - 12,00 €

           d) - Serbia - 13,00 €

           e) - Iceland - 16,00 €

           f) - Ukraine - 13,00 €

           g) - United Kingdom - 5,00 €

6.5 - The final value is confirmed by Só Algarve, after order preparation, depending on the weight, volume, destination country and shipping option.

    6.5.1- For express parcel shipments abroad, the volumetric weight of the parcel is calculated. If the volumetric weight is greater than the actual weight, the shipping price is applied according to the volumetric weight. You can calculate the volumetric weight of your order using the calculators of our carriers DPD and CTT

6.6 -We are not responsible for any delay in shipping and delivery of the order, and the indicated deadlines may change due to unforeseen causes.

6.7 - Orders are dispatched daily, from Monday to Friday, except local, regional, national holidays, vacation periods or external events (such as strikes, natural disasters, among others) that make it impossible to fulfill the respective service.

6.8 - We are not committed to the immediate shipment of orders after payment confirmation due to reasons that transcend our service.

6.9 - If the order number is not correctly identified and the respective proof of payment is sent, the products will again be available within the established period of 24 hours, subject to being purchased by another customer.

6.10 - The delivery of orders will be made to the address indicated by the user when placing the order.

6.11 - The customer is advised to check the package of the order upon delivery, if it is in perfect condition or to open the package in front of the carrier for verification, even after signing the guide.

      6.11.1 - Whenever there is any deterioration in the packaging that may cause damage to the article (s), you must indicate it, describing it in the delivery note of the carrier accompanied by your signature.

     6.11.2 - You must also confirm by email, that same deterioration, on the same day, or at the latest, on the first business day following receipt of your order.

     6.11.3 - Any claim can only be considered, when properly marked on the delivery note of the carrier and confirmed via email or telephone. If these procedures have not been carried out, Só Algarve will not assume any responsibility towards the customer.

6.12 - The customer is responsible for the correct introduction and update of the shipping address, as well as for the receipt of the order.

7 - Order cancellation

7.1 - Orders that are not paid and confirmed within 48 hours will be canceled.

7.2 - The cancellation of the order will only be accepted when the goods have not yet been dispatched by Só Algarve.

7.3 - To formalize the order, send an email to: geral@soalgarve.pt with the order number and name and wait for confirmation of the cancellation.

8 - Right of free withdrawal

8.1 - The customer of Só Algarve has the right of free termination of the contract for the purchase and sale of products without the need to indicate any reason.

8.2 - The deadline for exercising the right of withdrawal expires 14 days from the day on which the customer or a third party appointed by the customer, other than the carrier, acquires physical possession of the property. Within that same period, the customer must return or deliver the product to Só Algarve.

8.3 - The customer is responsible for the costs of returning the order to Só Algarve.

8.4 - Free resolution effects:

     8.4.1 - In order to exercise your right of free resolution, you must inform us of your decision to terminate the contract through the Free Resolution Form, available at https://www.soalgarve.pt/img/cms/ Formulario_livre_resolucao.jpg, or by means of an unambiguous statement (for example, letter sent by mail or email to geral@soalgarve.pt).

     8.4.2 - If you make use of this possibility, we will send you an acknowledgment of receipt of the request for resolution without delay.

     8.4.3 - You can use the Free Resolution Form provided by Só Algarve, but this is not mandatory. The declaration can be sent to: Maria da Conceição Santos Guerreiro - Só Algarve, Sitio Bias do Sul- CP 910 Z, 8700-067 Moncarapacho.

     8.4.4 - Within the prescribed period, the product must be returned as delivered, without signs of use, with all parts and in the original packaging. If it is not in the conditions described, Só Algarve reserves the right not to accept its return.

8.5 - In case of termination of the contract, all payments made, including delivery costs, will be refunded to customers, without undue delay and, in any case, no later than 14 days from the date on which Só Algarve is informed of the resolution decision.

8.6 - Só Algarve may retain the refund until it has received the returned goods, or until it presents proof of shipment of the goods, whichever comes first.

8.7 - Só Algarve makes these reimbursements using the same payment method that the customer used in the initial transaction, unless expressly agreed otherwise by him; in any case the customer does not incur any costs as a result of such reimbursement.

8.8 - The customer is responsible for the costs of returning the order to Só Algarve.

8.9 - In the absence of any of the components of the product sold or, if any of them are not in perfect condition, there will be no refund.

8.10 - The return of the articles must respect the following conditions:

     i. The return of the articles must be done according to the way it was delivered, in the original packaging, with the completed return form. You cannot cancel the purchase if I have already used the goods. The right of return exists to allow the buyer to examine the product he has personally purchased. It cannot be used during the reflection period;

     ii. Returns will only be accepted in case of manufacturing defect;

     iii. Products made to order or clearly customized are not accepted for return.

9. Limitation of liability

9.1 - We make every effort to make useful information available and free from any error.

9.2 - If there is any inconsistency between the data presented and the actual characteristics of the product, please contact us immediately.

9.3 - If the price indicated is less than the value shown, we will refund the difference.

     9.3.1 - If the price is higher, we will contact you by email communicating the real value and await your decision.

9.4 - All purchases made in the online store of Só Algarve are subject to Portuguese legislation.

9.5 - In the event of a dispute and in compliance with Article 18 of Law No. 144/2015 of September 8, it is hereby informed that the entity for Alternative Resolution of Consumer Disputes is:
